Welcome to Caring Nannies. These Terms of Service (“Terms”) govern your access to and use of caringnannies.com (the “Site”) and the services we offer (the “Services”). By using the Site or our Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.
Acceptance of Terms
By submitting an inquiry, application, or other information through the Site, or by engaging Caring Nannies for nanny placement, babysitting, or related services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy.
Our Services
Caring Nannies is a nanny placement and family care referral agency serving the San Antonio and Austin, Texas areas. We help families connect with screened nanny candidates for full-time, part-time, night nanny, after-school, babysitting, and senior care arrangements. Caring Nannies is a referral agency: families employ nannies directly. We are not a staffing agency and do not employ the nanny candidates we refer.
User Obligations
You agree to:
- Provide accurate, current, and complete information when submitting forms or communicating with us;
- Use the Site and Services only for lawful purposes consistent with these Terms;
- Not attempt to circumvent, disable, or interfere with security or operational features of the Site;
- Not use the Site to transmit unlawful, harassing, defamatory, or otherwise objectionable content;
- Comply with applicable wage, tax, and employment laws once you employ a nanny placed through our agency.
Fees and Payments
Our fee structure (including registration fees, placement fees, membership fees, and any other charges) will be disclosed before you engage our Services and may be set out in a separate written agreement. All amounts are payable as described in that agreement. Payment processing is handled by Stripe.
SMS Messaging Terms
By providing your mobile phone number and opting in to receive SMS messages from Caring Nannies, you agree to receive text messages related to your inquiry, appointment scheduling, placement coordination, and customer service communications.
Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP at any time to unsubscribe from SMS communications. After replying STOP, you will receive one final message confirming your opt-out.
Caring Nannies is not responsible for delayed or undelivered messages. Delivery of messages is subject to the effective transmission from your wireless service provider/network operator and is outside of our control. Carriers are not liable for delayed or undelivered messages.
Consent to receive SMS messages is not a condition of purchase or use of our services. You may inquire about and use our services without opting in to SMS communications.
Intellectual Property
All content on the Site — including text, graphics, logos, photographs, and software — is the property of Caring Nannies or its licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written permission.
Third-Party Services and Links
The Site and Services may contain links to or integrations with third-party websites and services (for example, payment processing, background checks, scheduling tools, and analytics). We are not responsible for the content, policies, or practices of those third parties. Your use of any third-party service is governed by that third party’s terms.
Disclaimer of Warranties
The Site and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. While we screen and vet candidates carefully, we do not guarantee the conduct of any particular nanny or family, and you remain responsible for your own hiring and supervision decisions.
Limitation of Liability
To the fullest extent permitted by law, Caring Nannies and its owners, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to your use of the Site or Services. Our total liability for any claim arising out of or related to these Terms or the Services will not exceed the amount you paid to Caring Nannies in the twelve (12) months preceding the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Caring Nannies, its owners, employees, and affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your use of the Site or Services, your violation of these Terms, or your violation of any law or third-party right.
Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services will be resolved exclusively in the state or federal courts located in Bexar County, Texas, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Material changes will be communicated to active clients where appropriate. Continued use of the Site or Services after an update constitutes acceptance of the revised Terms.
